Notes on applying for a work visa for foreigners to work in China

中国工作签证又名外国人来华签证,外国人工作签证其实就是对工作类别的居留许可的俗称,是用人单位为外国就业者必须要办理的合法就业手续,最终大家拿到的工作签证叫做外国人居留许可,是贴在护照上的一种签证,而居留事由为工作。是专门为吸引外国人才到中国工作的签证,在2016年,签证通过“两证合一”,统一为《外国人工作许可证》。《外国人工作许可证》是外国人在中国工作的合法证件,“一人一号”。

A work visa in China is also known as a visa for foreigners to come to China. A work visa for foreigners is actually the common name for a residence permit for work, which is a legal employment procedure that employers must handle for foreign workers. It is a visa specifically designed to attract foreign talents to work in China, and in 2016, the visa was unified into a "Work Permit for Foreigners" through the "two permits in one". The Foreigner Work Permit is a legal document for foreigners to work in China, "one person one".

那么申请Z字签证需要哪些资料?

So what documents do you need to apply for a Z visa?

1.外国专家局签发的《外国专家来华工作许可证》或《外国人工作许可通知》;

1. "Permit for Foreign Experts to Work in China" or "Notice of Work Permit for Foreigners" issued by the Bureau of Foreign Experts.

2.人力资源和社会保障部门签发的《外国人就业许可证书》;工作期限不超过90日的,还需提供《外国人在中国短期工作证明》,且申请人须在《外国人在中国短期工作证明》上注明的起始日期前申请签证,工作时间不能超过《外国人在中国短期工作证明》所注期限;

2. Certificate of Employment Permit for Foreigners issued by the Human Resources and Social Security Department; if the working period does not exceed 90 days, the Certificate of Short-term Work for Foreigners in China is also required, and the applicant must apply for the visa before the starting date stated in the Certificate of Short-term Work for Foreigners in China, and the working period cannot exceed the period noted in the Certificate of Short-term Work for Foreigners in China.

3.文化行政主管部门签发的营业性文艺演出批件(只适用于来华进行营业性演出的申请人);演出期限不超过90日的,还需提供《外国人在中国短期工作证明》,且申请人须在《外国人在中国短期工作证明》上注明的起始日期前申请签证,演出时间不能超过《外国人在中国短期工作证明》所注期限;

3. Approval for business cultural performance issued by the competent cultural administrative department (only applicable to applicants coming to China for business performance); if the performance period does not exceed 90 days, the applicant must also provide the Certificate of Short-term Work in China for Foreigners, and the applicant must apply for a visa before the starting date indicated on the Certificate of Short-term Work in China for Foreigners, and the performance period cannot exceed the period indicated on the Certificate of Short-term Work in China for Foreigners The period noted on the Certificate of Short-term Work in China.

4.中国海洋石油总公司签发的《外国人在中华人民共和国从事海上石油作业邀请信》;

根据我国法律规定,外国人在中国就业必须办理工作签证。那么外国人在华就业可能会涉及的法律问题包括:

According to the laws of China, foreigners must apply for a work visa for employment in China. Then the legal issues that may be involved in the employment of foreigners in China include

1.劳动合同

1.Labor contract

企业应当自用工之日起一个月内与该外国人签订劳动合同,否则该外国人有权要求用人单位承担未签订劳动合同的法律责任。

The enterprise shall sign an employment contract with the foreigner within one month from the date of employment, otherwise the foreigner has the right to demand the employer to bear the legal responsibility for not signing the employment contract.

关于劳动合同的期限。企业与被聘用的外国人应依法订立劳动合同,劳动合同的期限最长不得超过五年。劳动合同期限届满即行终止,但按该规定第十九条的规定履行审批手续后可以续订。

Regarding the duration of the labor contract. The enterprise and the foreigner employed shall enter into a labor contract in accordance with the law, the maximum term of which shall not exceed five years. The term of the labor contract shall be terminated upon its expiration, but may be renewed after fulfilling the approval procedures as stipulated in Article 19 of the Regulations.

2. Overtime Work

依法就业的外国人如在法定工作时间外加班,也有享受加班工资的权利。因此,对于依法就业的外国人,如果在超过法定工作时间外劳动,企业应当依法支付加班工资。

Foreigners employed in accordance with the law are entitled to overtime pay if they work overtime outside the statutory working hours. Therefore, if a foreigner employed in accordance with the law works beyond the legal working hours, the enterprise shall pay overtime wages in accordance with the law.

3.社会保险

3. Social Insurance

外国人也要依法缴纳社会保险。在《社会保险法》实施前,用人企业为外国人缴纳社会保险的情形非常罕见,比较多的都是通过商业保险来履行相关义务。

Foreigners are also required to pay social insurance in accordance with the law. Before the implementation of the Social Insurance Law, it was very rare for the employer to pay social insurance for foreigners, and it was more common to fulfill the relevant obligations through commercial insurance.

如果外籍员工在该国没有缴纳相应的社会保险,或者已经超过了社保双边协议约定的免缴期限,用人单位还是要依法为其缴纳社会保险。

If a foreign employee has not paid social insurance in the country or has exceeded the exemption period agreed in the bilateral social insurance agreement, the employer is still required to pay social insurance for him/her according to the law.

4.休息休假

在用人单位依法就业的外国人,同样享受年休假、法定节假日、婚假、产假等法定假期。

Foreigners who are legally employed by the employer are also entitled to annual leave, statutory holidays, wedding leave, maternity leave and other statutory holidays.

5.最低工资

5. Minimum Wage

对于在用人企业依法就业的外国人,其提供正常劳动后的工资标准不得低于当地最低工资标准。
