Nationality determination - how to determine?

Nationality is the core link of the legal connection between an individual and a country. It not only determines an individual's political rights and the attribution of social welfare, but also affects various rights and interests such as cross - border residence, work, and travel. The logic of nationality conferment always revolves around three core principles. China's nationality system, in particular, has formed a judgment system that combines international commonalities and local characteristics within this framework. Whether it is the nationality choice of a newborn in a transnational family or the identity determination involved when a foreign national applies for permanent residence in China, understanding these principles is the first crucial step in understanding nationality issues.

Determination of nationality: What principles are followed?

There is no unified nationality law in the world. Every sovereign state has the right to determine who its nationals are according to its own laws. However, looking at the laws of various countries, the principles for conferring nationality are mainly based on the following three:

(Jus Sanguinis)

Jus Sanguinis

Core: Based on the nationality of the parents, rather than the place of birth.

Meaning: Regardless of the country where the child is born, their nationality is automatically inherited from one or both of their parents.

Countries adopting it: This is the main principle in most countries in Europe and Asia. For example, Germany, Italy, Japan, China, etc.

Example: A Chinese couple (where the Chinese father/mother has not obtained a US green card) gives birth to a child in the United States. According to Article 5 of the Nationality Law of the People's Republic of China, this child has Chinese nationality.

(Jus Soli)

Jus Soli

Core: Based on the place of an individual's birth.

Meaning: Regardless of the nationality of the parents,as long as a person is born within the territory of the country, they automatically acquire the nationality of that country.

Countries that adopt it: American countries have traditionally widely adopted this principle, such as the United States, Canada, Brazil, Argentina, etc.

Example: Any person born on the territory of the United States automatically becomes a U.S. citizen (except for children of certain personnel such as diplomats).

Mixism

Core: Combine jus sanguinis and jus soli.

Current situation: This is the most mainstream approach in the world today. The vast majority of countries adopt both principles simultaneously, but with different emphases.

Examples:

France: Primarily based on jus sanguinis, but the children of foreigners born in France can also acquire French nationality after meeting certain conditions (such as continuous residence).

Australia: Those born in Australia do not necessarily obtain nationality (unless one of the parents is an Australian citizen or a permanent resident), but the children of citizens can acquire nationality regardless of where they are born. It is a mixed approach with a bias towards jus sanguinis.

Principles for determining Chinese nationality:

China's Nationality Law mainly adopts the principle of jus sanguinis as the primary principle and jus soli as the supplementary principle.

· If both or one of the parents is a Chinese citizen and the person is born in China, they have Chinese nationality.

· If both or one of the parents is a Chinese citizen and the person is born abroad, they have Chinese nationality; however, if both or one of the parents is a Chinese citizen and has settled abroad, and the person has foreign nationality at birth, they do not have Chinese nationality.

· If the parents are stateless or of unknown nationality and have settled in China, and the person is born in China, they have Chinese nationality.

For the general public, understanding the differences among jus sanguinis, jus soli, and the mixed principle can help them more clearly deal with practical issues such as the nationality registration of newborns and identity determination in transnational marriages. For foreigners who are concerned about China's permanent residence policy, mastering the determination rules is the key to handling identity transition and avoiding nationality conflicts. With the deepening of globalization, nationality issues will become more complex. Understanding these principles means having the "key" to understanding the nationality system, and it also enables people to more calmly face cross - cultural and cross - border identity challenges.
