Nationality, as the legal qualification of an individual as a citizen or national of a particular country, is the cornerstone of personal identity and international relations. It determines an individual's rights, obligations, and the state of protection. However, in today's globalization, cross - border movement of people is becoming increasingly frequent, and nationality issues have become more complex. This article will delve into three core questions: how is nationality determined? What is nationality conflict? And how to apply for nationality?

Determination of nationality: What principles are followed?
There is no unified nationality law in the world. Every sovereign state has the right to determine who its nationals are according to its own laws. However, looking at the laws of various countries, the principles for conferring nationality are mainly based on the following three:

(Jus Sanguinis)

Jus Sanguinis

Core: Based on the nationality of the parents, rather than the place of birth.

Meaning: Regardless of the country where the child is born, their nationality is automatically inherited from one or both of their parents.

Countries adopting it: This is the main principle in most countries in Europe and Asia. For example, Germany, Italy, Japan, China, etc.

Example: A Chinese couple (where the Chinese father/mother has not obtained a US green card) gives birth to a child in the United States. According to Article 5 of the Nationality Law of the People's Republic of China, this child has Chinese nationality.

Jus Soli

Core: Based on the place of an individual's birth.

Meaning: Regardless of the nationality of the parents,as long as a person is born within the territory of the country, they automatically acquire the nationality of that country.

Countries that adopt it: American countries have traditionally widely adopted this principle, such as the United States, Canada, Brazil, Argentina, etc.

Example: Any person born on the territory of the United States automatically becomes a U.S. citizen (except for children of certain personnel such as diplomats).

Mixism

Core: Combine jus sanguinis and jus soli.

Current situation: This is the most mainstream approach in the world today. The vast majority of countries adopt both principles simultaneously, but with different emphases.

Examples:

France: Primarily based on jus sanguinis, but the children of foreigners born in France can also acquire French nationality after meeting certain conditions (such as continuous residence).

Australia: Those born in Australia do not necessarily obtain nationality (unless one of the parents is an Australian citizen or a permanent resident), but the children of citizens can acquire nationality regardless of where they are born. It is a mixed approach with a bias towards jus sanguinis.

Principles for determining Chinese nationality:

China's Nationality Law mainly adopts the principle of jus sanguinis as the primary principle and jus soli as the supplementary principle.

· If both or one of the parents is a Chinese citizen and the person is born in China, they have Chinese nationality.

· If both or one of the parents is a Chinese citizen and the person is born abroad, they have Chinese nationality; however, if both or one of the parents is a Chinese citizen and has settled abroad, and the person has foreign nationality at birth, they do not have Chinese nationality.

· If the parents are stateless or of unknown nationality and have settled in China, and the person is born in China, they have Chinese nationality.

Nationality conflict: When there is "overlap" or "vacuum" in the law
Nationality conflict refers to a state in which a person has two or more nationalities simultaneously or has no nationality at all.

Positive conflicts (dual or multiple nationalities)

Causes: Due to differences in the principles of nationality laws of various countries, there is an "overlap" in the application of laws.

Case A (arising from birth): A baby is born in the United States (jus soli), and his parents are Japanese citizens (jus sanguinis). This child is born with both American and Japanese nationalities simultaneously.

Case B (arising from application): A citizen of a country that allows dual nationality (such as Canada) obtains the nationality of another country that also allows dual nationality (such as France) through a naturalization application, thus having dual nationality.

Problems brought about:

Conflict in fulfilling obligations: One may be required to perform military service and pay taxes by two countries simultaneously.

Conflict in diplomatic protection rights: When encountering troubles in a third country, the two countries may simultaneously claim or shirk the consular protection rights.

Inconvenience in travel: Entering and exiting the country with different passports may cause trouble.

Negative conflict (statelessness)

Cause: A "legal vacuum zone".

Case: A stateless couple gave birth to a child in a country that adheres to the principle of jus sanguinis. The country does not grant nationality based on birthplace, and the child cannot inherit any nationality from their parents, thus becoming stateless.

Problems brought about: Stateless people lack the protection of any country, and they will face huge difficulties in basic human rights such as education, medical care, employment, and travel.

China's stance:

China does not recognize dual nationality for Chinese citizens.

According to Article 9 of the Nationality Law of the People's Republic of China, any Chinese citizen who has settled abroad and voluntarily acquired foreign nationality shall automatically lose Chinese nationality.

For situations like the aforementioned "China-US babies", Chinese law stipulates that if the parents are Chinese citizens without foreign permanent residency status, the child acquires Chinese nationality at birth in a foreign country. However, if the child is born in the United States, according to US law, the child also has US nationality. This actually constitutes a nationality conflict. In practice, China regards such a child as a Chinese citizen and does not recognize the legal effect of the US nationality within China's territory. Such a child cannot enjoy US consular protection. Until the child reaches 18 years old, he or she can choose to retain the nationality of one country and give up that of the other.

Application for nationality: The path to naturalization
For those who do not meet the conditions for automatically acquiring nationality, they can apply for the nationality of a country through the "naturalization" process. The naturalization conditions vary greatly among countries, but usually include the following common requirements:

1. Residence Requirements (Immigration Detention): Applicants usually need to legally and continuously reside in the applying country for a certain number of years (for example, 5 years in the United States, usually 5 - 6 years in the United Kingdom, and living in Canada for 3 years within 5 years).

2. Identity Requirements: Holding a valid permanent residency (green card) is a common prerequisite.

3. Conduct Requirements: It is necessary to provide a certificate of no criminal record and have good moral conduct.

4. Language Ability: Most countries require applicants to reach a certain proficiency level in the official language (such as English in the United States and German in Germany).

5. Legal and Economic Knowledge: Usually, it is necessary to pass a naturalization test, which examines the understanding of the country's history, government structure, civil rights and obligations. At the same time, it is necessary to prove a stable source of income and not become a burden on society.

6. Oath of Naturalization: The last step is usually to participate in an oath - taking ceremony, swear allegiance to the new country, and give up allegiance to the original country (if the country does not allow dual citizenship).

Apply for Chinese nationality:

Chinese nationality is one of the most difficult nationalities to obtain in the world.

Article 7 of the Nationality Law of the People's Republic of China stipulates that foreigners or stateless persons who apply to join the Chinese nationality must meet one of the following conditions:

* Be a close relative of a Chinese citizen;

* Reside permanently in China;

* Have other legitimate reasons.

The power of approval lies with the Ministry of Public Security of the People's Republic of China, and the final approval authority is extremely high. After successful approval, foreign nationality can no longer be retained.
